They certainly did not think on birth tourism back then, but that is the letter of the law, even if it has been abused in industrial scale. I do not know the legal details. Could it be interpreted as requiring some intention of really moving to the USA? Like, if the woman just travels to give birth, keeping her life, job, $$, etc, in the home country, with no arrangements to set up a new life in the USA, could it be interpreted as 'refusing to enter the legal jurisdiction'??
